1. Introduction
Uppercut is a referral-driven recruiting platform operated by Third One Group LLC under the Uppercut brand (“Uppercut,” “we,” “our,” or “us”). Uppercut connects referrers, candidates, and hiring companies through a structured referral system that tracks introductions, manages recruiting workflows, and distributes rewards when eligible placements succeed.
This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, how long we retain it, and the rights you may have over it.
By using Uppercut, you acknowledge that we collect, use, disclose, and retain personal information as described in this Privacy Policy. Your use of Uppercut is also governed by our Terms of Service.
2. Who This Policy Applies To
This Policy applies to all individuals who interact with Uppercut, including:
- Referrers: individuals who share referral links, refer candidates, refer clients, or participate in Uppercut's reward program.
- Candidates: individuals who apply for roles through Uppercut, including through a Referrer's unique application link.
- Clients: hiring companies, hiring managers, business contacts, and employers introduced to or engaged by Uppercut.
- Visitors: anyone who visits the Uppercut website without creating an account.
Each group has a distinct relationship with Uppercut and different expectations about data use. We treat each group's data accordingly.
3. Information We Collect
Referrer Information
We may collect the following information from Referrers:
- Account data, such as full name, email address, phone number, and login credentials managed through our authentication provider.
- Referral activity, including unique referral links, roles shared, candidates who applied through a Referrer's link, client referrals submitted, timestamps, status updates, and reward eligibility.
- Payout information, including Stripe Connect onboarding status, payout status, tax reporting status, and payment history. Bank account, debit card, and other financial account details are collected and processed by Stripe. Uppercut does not store raw bank account numbers, card numbers, or routing numbers.
- Tax information required for reporting and compliance, such as information needed to issue tax forms where required by law.
- Communication records, including messages, support requests, and communications with Uppercut.
Candidate Information
Candidates provide their own information directly when they apply through an Uppercut application form, including when they apply through a Referrer's unique referral link.
We may collect the following information from Candidates:
- Identification and contact data, such as full name, email address, phone number, and location.
- Professional data, such as resume or CV, work history, job titles, skills, education, certifications, compensation expectations, work authorization, and availability.
- Profile links, such as LinkedIn, GitHub, portfolio, personal website, or other professional profiles voluntarily provided.
- Application data, such as roles applied to, referral source, application timestamps, pipeline stage, interview status, placement status, and guarantee period status.
- Communications with Uppercut, including emails, messages, interview coordination, and recruiter notes.
Referrers do not submit applications on behalf of Candidates. Referrers may share unique application links with people in their network, but Candidates must submit their own information directly.
A Referrer may apply for a role themselves through their own referral link. In that case, the Referrer is also treated as a Candidate for purposes of the recruiting process and privacy practices described in this Policy.
Client Information
We may collect information from Clients and prospective Clients, including:
- Contact data, such as name, job title, email address, phone number, and company affiliation.
- Company data, such as company name, size, industry, location, hiring needs, hiring budget, and role requirements.
- Engagement data, such as job descriptions, candidate feedback, placement records, recruiting communications, and payment-related records.
Automatically Collected Information
When you visit or use Uppercut, we may automatically collect:
- IP address and approximate location.
- Device and browser type.
- Operating system.
- Pages visited.
- Session duration.
- Clickstream data.
- Cookie and tracking technology data.
Note on Sensitive Information
We do not intentionally collect sensitive personal data such as racial or ethnic origin, health information, political beliefs, religious beliefs, or union membership.
However, resumes, profiles, or application materials may incidentally contain sensitive or protected information. We do not use such information for discriminatory purposes and do not request sensitive information unless legally required or voluntarily provided by the user.
4. Legal Basis for Processing
Where applicable law requires a legal basis for processing personal data, we rely on the following:
- Legitimate interests: operating the referral platform, managing recruiting workflows, tracking referral ownership, preventing fraud, communicating with users, and managing payouts.
- Contract performance: processing data necessary to provide the Services, administer referral rewards, manage recruiting relationships, and satisfy user requests.
- Consent: where required by law, including optional communications, certain cookies, marketing messages, and user-submitted information.
- Legal obligations: complying with tax reporting, accounting, employment, anti-fraud, dispute resolution, and regulatory obligations.
5. How We Use Your Information
We use personal information to:
- Operate and improve the Uppercut platform.
- Create and manage user accounts.
- Authenticate users through Clerk.
- Track referral links, referral ownership, and reward eligibility.
- Process candidate applications.
- Evaluate candidates for job opportunities.
- Communicate with candidates, referrers, and clients.
- Share candidate information with appropriate hiring clients.
- Manage client relationships and recruiting workflows.
- Process referral rewards through Stripe Connect.
- Maintain tax, accounting, payout, and legal records.
- Prevent fraud, abuse, duplicate submissions, and payout manipulation.
- Enforce our Terms of Service.
- Comply with legal obligations.
We do not sell personal data to third parties.
6. How We Share Information
With Uppercut Personnel and Contractors
Candidate profiles and application information may be shared with Uppercut personnel, recruiters, contractors, or service providers who need access to perform recruiting, operational, support, or administrative functions.
With Hiring Clients
Candidate profiles, resumes, and relevant application materials may be shared with Clients that have active, legitimate job opportunities for which the Candidate may be a fit.
We do not share Candidate data for unrelated advertising or non-recruiting purposes.
With Referrers
Referrers may be able to view limited information about Candidates who apply through their unique referral links. This dashboard visibility is limited to the Candidate's name and current referral or application status, such as submitted, under review, interviewing, placed, in guarantee period, reward eligible, not selected, duplicate, or ineligible.
Uppercut does not disclose detailed interview feedback, compensation details, employer communications, recruiter notes, private hiring feedback, or other sensitive recruiting information to Referrers unless appropriate and permitted.
With Payment Processors
Payout data is shared with Stripe to facilitate referral reward payments. Stripe's own terms and privacy policy govern its processing of financial information.
Uppercut does not store raw bank account numbers, debit card numbers, credit card numbers, or routing numbers.
With Technology Service Providers
We may share information with third-party vendors that help us operate Uppercut, including cloud hosting providers, database providers, authentication providers, email providers, analytics providers, customer support tools, CRM or ATS tools, and security tools.
These providers are authorized to use personal information only as needed to provide services to Uppercut.
For Legal Compliance or Business Transfers
We may disclose information if required by law, court order, subpoena, legal process, regulatory request, or to protect the rights, safety, property, or security of Uppercut, users, candidates, clients, or others.
We may also disclose information in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction.
7. Referral Ownership and Duplicate Protection
A core function of Uppercut is establishing and protecting referral ownership. Referrers receive unique application links tied to their accounts. When a Candidate applies through a Referrer's unique link, Uppercut records the referral source and assigns referral attribution based on platform records, timestamps, duplicate checks, and eligibility rules.
The following rules govern how we record and manage referral priority:
- Unique link attribution: Each Referrer receives a unique application link tied to their account. When a Candidate submits an application through that link, Uppercut records the Referrer associated with that application.
- Candidate-submitted applications: Candidates must submit their own applications. Referrers are not permitted to apply on behalf of Candidates.
- Self-referrals: A Referrer may apply for a role themselves through their own referral link and may be eligible for the listed reward if all payout conditions are satisfied.
- Timestamp integrity: Applications are timestamped at the moment of submission. Timestamps, platform logs, and internal records may be used to determine referral ownership in the event of a dispute.
- Duplicate detection: We check existing records before assigning or confirming referral ownership. If a Candidate has already applied, has already been referred, or is already known to Uppercut for the same role or opportunity, a later submission may be marked as duplicate or ineligible.
- Referrer dashboard: Referrers may view limited dashboard information for Candidates who apply through their unique links. This is limited to Candidate name and current status.
- Ownership window: Referral ownership for a given Candidate and role combination remains active for the duration of the hiring process and through the applicable guarantee period, unless otherwise stated in the role listing or determined by Uppercut's eligibility rules.
Referral ownership records are retained for a minimum of three (3) years from the date of submission to support dispute resolution, fraud prevention, tax records, and business operations.
8. Payout Data and Financial Information
Uppercut processes referral rewards through Stripe Connect or another payment provider selected by Uppercut.
When you enroll to receive payouts:
- You may be required to complete Stripe's onboarding process.
- Stripe may collect identity, bank, debit card, tax, and verification information.
- Uppercut does not store raw bank account numbers, card numbers, or routing numbers.
- Uppercut retains records of payout amounts, payout dates, payout status, and related tax or accounting information.
- Where required by law, Uppercut may issue tax forms and report earnings to tax authorities.
Payout records are retained for at least seven (7) years for tax, accounting, and legal compliance.
9. Data Retention
We retain personal information only as long as reasonably necessary for the purposes described in this Policy, unless a longer retention period is required or permitted by law.
General retention periods include:
- Active Referrers: retained for the duration of active platform engagement and for a reasonable period after the last referral, payout, or account activity.
- Referral ownership records: retained for at least three (3) years from the date of submission or last activity for dispute resolution, fraud prevention, and business operations.
- Candidate data: generally retained for up to two (2) years from last activity, unless longer retention is reasonably necessary for placement records, legal obligations, dispute resolution, or legitimate business purposes.
- Client data: retained for the duration of the client relationship and for a reasonable period following the last engagement.
- Payout and tax records: retained for at least seven (7) years for tax, accounting, and legal compliance.
- Security, fraud, and platform logs: retained as reasonably necessary to protect the platform and enforce our Terms.
You may request deletion of your personal information, subject to legal, tax, accounting, dispute resolution, and legitimate business retention obligations.
10. Data Security
We implement reasonable and appropriate technical and organizational safeguards designed to protect personal information, including:
- Encryption of data in transit where appropriate.
- Access controls and role-based permissions.
- Authentication and session management through Clerk.
- Limited access to sensitive information based on business need.
- Periodic review of security settings, access permissions, and platform safeguards.
- Internal procedures for responding to suspected security incidents.
No method of electronic transmission or storage is completely secure. We cannot guarantee absolute security.
If a data breach occurs and notification is required by law, we will notify affected users and regulators as required by applicable law.
11. Cookies and Tracking Technologies
Uppercut may use cookies, pixels, analytics tools, and similar technologies to operate the website, improve user experience, understand platform usage, and support marketing or measurement.
Uppercut may use Google Analytics to understand how visitors use the website, including pages viewed, device and browser information, approximate location, referral source, and interactions with the site. Google Analytics helps us improve the platform and measure website performance. Where required, we only load Google Analytics after you consent to analytics cookies. You may decline analytics cookies through our cookie banner or change your preference using the Cookie Preferences link in the footer.
Necessary cookies, including authentication and security cookies, may be used to operate the platform and cannot be disabled through the analytics cookie banner.
Types of cookies and tracking technologies may include:
- Strictly necessary cookies required for platform functionality.
- Authentication and session cookies.
- Analytics cookies that help us understand how visitors use the website.
- Marketing or measurement cookies, where permitted by law.
Where required, we provide cookie choices or consent mechanisms. You may also control cookies through your browser settings.
Our website does not currently respond to browser “Do Not Track” signals.
12. Automated Decision-Making
Uppercut may use automated tools to assist with duplicate detection, referral attribution, fraud prevention, application tracking, and candidate matching.
These tools assist human decision-making but do not replace it:
- Candidate submissions and hiring-related decisions may involve human review.
- Referral ownership determinations may use automated timestamp and link tracking but are subject to human review upon dispute.
- Fraud or abuse flags may be reviewed by Uppercut before final account action is taken.
If you believe an automated process has adversely affected you, you may request human review by contacting legal@uppercutpay.com.
13. Children's Privacy
Uppercut is intended for individuals 18 years of age or older.
We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected personal information from a minor, we will take reasonable steps to delete it.

14. Your Privacy Rights
Depending on your location, you may have rights regarding your personal information, including:
- The right to access personal information we hold about you.
- The right to correct inaccurate or incomplete information.
- The right to request deletion of personal information.
- The right to restrict or object to certain processing.
- The right to withdraw consent where processing is based on consent.
- The right to data portability, where applicable.
- The right not to be discriminated against for exercising privacy rights.

We may need to verify your identity before responding. We will respond within the time required by applicable law.
15. International Data Transfers
Uppercut is based in the United States. If you access or use Uppercut from outside the United States, your information may be transferred to and processed in the United States and other jurisdictions where our service providers operate.
Where required, we use appropriate safeguards for international data transfers.
16. Third-Party Services
Uppercut may use third-party service providers to operate the platform, including:
- Stripe for payment processing and payouts.
- Clerk for authentication and session management.
- Cloud infrastructure providers for hosting, storage, and databases.
- Email and communication providers.
- Analytics and platform monitoring tools.
- CRM, ATS, or recruiting workflow tools.
Each provider's processing of personal information may also be governed by its own terms and privacy policy.
17. Region-Specific Disclosures
California Residents
If you are a California resident, you may have rights under the California Consumer Privacy Act and California Privacy Rights Act, including the right to know, access, correct, delete, and opt out of certain uses of personal information.
Uppercut does not sell personal information. Uppercut does not share personal information for cross-context behavioral advertising as those terms are defined under California law, unless otherwise disclosed through a separate notice or consent mechanism.

EU, EEA, and UK Residents
If you are located in the EU, EEA, or UK, you may have rights under the GDPR or UK GDPR, including the right to access, correct, delete, restrict, object, withdraw consent, and lodge a complaint with a supervisory authority.
We encourage you to contact us first at privacy@uppercutpay.com so we can try to resolve your concern.
18. Changes to This Policy
We may update this Privacy Policy from time to time.
If we make material changes, we will provide notice by posting the updated Policy on our website and updating the “Last Updated” date. Where appropriate, we may also notify users by email or through the platform.
Your continued use of Uppercut after an updated Privacy Policy becomes effective means you acknowledge the updated Policy.
